Somewhere in Africa as… Magistrate Sues Side Chick for Wrecking her Marriage

Chivhu-based magistrate Sandra Mupindu has taken her husband’s alleged mistress, Catherine Tatenda Chitopota, to the High Court, suing for damages over an affair that’s rocked her marriage. Chitopota, a former intern at Simon Mupindu’s law firm, is accused of engaging in a long-running relationship with him — a relationship that has reportedly produced three children.

In her suit, Mupindu claims the affair caused emotional distress and led her husband to leave their matrimonial home to live with Chitopota. She is seeking damages for both loss of affection and dignity.

Chitopota tried to have the case dismissed, arguing that Mupindu had long been aware of the affair, even accepting customary compensation in 2014. She also insisted the case was time-barred and that Simon should be formally added to the proceedings.

But Justice Fatima Maxwell ruled otherwise, stating that adultery claims remain valid if the relationship continues. Quoting her, “The plaintiff’s assertions indicate that the sexual liaison has continued… implying a lack of intent from the defendant to cease such conduct.”

She also dismissed the non-joinder objection, allowing the lawsuit to proceed.

The courtroom drama continues — and yes, it’s headed to trial.
